OPPORTUNITYZA TERMS AND CONDITIONS

1. INTRODUCTION

These Terms and Conditions govern access to and use of the OpportunityZA website, Candidate and Employer accounts, vacancy listings, job-advertising packages, application tools, promotional services and related platform features.
By creating an account, purchasing or activating a package, submitting a vacancy, applying for an opportunity or otherwise using OpportunityZA, the user agrees to these Terms and Conditions, together with the OpportunityZA Privacy Policy and Refund and Cancellation Policy.
If a user does not agree with these Terms and Conditions, the user should not create an account, purchase a service or use the platform.

2. PLATFORM OPERATOR AND SUPPLIER DETAILS

OpportunityZA is a trading name used by Pamela Madlala, an individual sole proprietor operating in South Africa.

OpportunityZA operates primarily as an online job-advertising and career-information platform serving Employers and job seekers across South Africa.
OpportunityZA is not currently registered as a private company and does not have a CIPC company registration number.
General enquiries and formal notices may be sent to info@opportunityza.com. OpportunityZA aims to acknowledge enquiries within two business days.

3. NATURE OF THE SERVICE

OpportunityZA is a job-advertising and career-information platform.
OpportunityZA is not a recruitment agency, labour broker, Employer, employee, placement agency or representative of an Employer or Candidate unless a separate written agreement expressly states otherwise.
OpportunityZA may provide:
• Vacancy advertising
• Candidate and Employer account registration
• Candidate and Employer profiles
• Candidate application functionality
• Employer application-management tools
• Featured and Urgent vacancy placement
• Organic social-media vacancy promotion
• Single-vacancy advertising packages
• Multi-vacancy job-credit packages
• Career-related information and resources
• Other approved advertising and promotional services
OpportunityZA does not guarantee:
• A minimum number of vacancy views or clicks
• Applications or suitable Candidates
• Interviews or shortlists
• Employment offers
• Placements or successful hires
• Social-media reach, impressions or engagement
• Permanent first-position placement
• That every Employer, Candidate, vacancy or application will be approved

4. ACCOUNT REGISTRATION

Candidates and Employers must register using accurate, current and complete information.
Users are responsible for:
• Maintaining the confidentiality of account details
• Choosing and protecting a secure password
• Ensuring that account information remains accurate
• Preventing unauthorised use of the account
• Not sharing an account with an unrelated person or organisation
• Not creating duplicate accounts to avoid Trial, package or platform restrictions
• Informing OpportunityZA of suspected unauthorised account access
OpportunityZA may suspend, restrict or terminate an account where information is inaccurate, misleading, duplicated, unverifiable or used in breach of these Terms and Conditions.

5. CANDIDATE ACCOUNTS

Candidates may be required to complete a Candidate profile before applying for a vacancy.
Candidate information may include:
• Name and contact information
• Education and qualifications
• Skills and experience
• Employment history
• Uploaded CVs
• Application messages
• Work and opportunity preferences
• Applications submitted through OpportunityZA
Candidates must ensure that all information supplied is accurate and does not misrepresent identity, qualifications, experience, employment history or eligibility.
When a Candidate applies for a vacancy, relevant profile, CV and application information may be made available to the Employer responsible for that vacancy.
At launch, Employers may access Candidates who applied to their own vacancies, subject to Candidate consent and applicable platform terms.
General access to Candidate CVs, contact information or the broader Candidate database is not automatically included in an Employer job-advertising package.
Candidates may not use Candidate accounts to purchase Employer packages or submit vacancies.

6. EMPLOYER REGISTRATION AND VERIFICATION

An Employer must create an Employer account before purchasing, activating or using an Employer advertising package.
OpportunityZA may request information including:
• Company or agency name
• Business registration details, where applicable
• Contact-person information
• Official business email address
• Company website
• Official company or agency profile link
• Industry
• Direct Employer or agency classification
• Hiring-company information
• Confirmation that Candidates will not be charged to apply
• Additional information reasonably required for verification
Employer registration does not guarantee verification or approval.
OpportunityZA may approve, request additional information, restrict, suspend or reject an Employer account.
A purchased package does not override the Employer-verification process.

7. VACANCY SUBMISSION AND REVIEW

Every vacancy submitted to OpportunityZA is subject to review.
Payment for a package does not guarantee that a vacancy will be approved or published.
Employers must provide accurate and sufficiently complete vacancy information, including where applicable:
• Vacancy title
• Hiring company
• Agency or authorised recruiter
• Location and work arrangement
• Employment type
• Responsibilities
• Requirements
• Skills and experience
• Compensation information
• Approved application method
• Closing date
• Company and Employer information
A submitted vacancy may initially appear as Pending Review.
OpportunityZA may:
• Approve and publish the vacancy
• Request corrections or additional information
• Return the vacancy to Draft
• Decline to publish the vacancy
• Suspend publication
• Remove an inaccurate, unsafe, unlawful or expired vacancy
Where changes are required, the Employer must edit the existing vacancy instead of creating a new submission.
The Employer should notify OpportunityZA after the required changes have been completed.

8. PROHIBITED VACANCY CONTENT

Employers may not submit vacancies that:
• Require Candidates to pay an application, registration, training, placement or interview fee
• Misrepresent the Employer, vacancy, compensation or application process
• Contain fraudulent, misleading or unverifiable information
• Request unnecessary financial, banking or identity information
• Promote unlawful or unsafe activity
• Contain unlawful discriminatory requirements
• Use third-party branding or content without permission
• Direct Candidates to an unsafe or unverifiable application method
• Contain malicious links or harmful files
• Infringe intellectual-property, confidentiality or privacy rights
• Misrepresent an agency’s authority to recruit for another organisation
• Attempt to collect Candidate information for unrelated marketing or commercial purposes
OpportunityZA may decline or remove prohibited content and may suspend the responsible account.

9. EMPLOYER PACKAGES

The package features and prices displayed on the Employer Packages page form part of these Terms and Conditions.
OpportunityZA may offer the following packages.

9.1 FOUNDING EMPLOYER TRIAL

The Founding Employer Trial includes:
• One Standard vacancy listing
• A fourteen-day listing period
• Employer profile and company logo
• Category and location placement
• Management of the Employer’s own applicants
• Vacancy review before publication
The Founding Employer Trial:
• Is available once per verified legal company
• Is intended for new verified Employers
• May exclude agencies unless manually authorised by OpportunityZA
• Does not include Featured placement
• Does not include Urgent placement
• Does not include guaranteed social-media promotion
• Does not include an extension or repeat Trial
• Does not include access to the broader Candidate database
OpportunityZA may refuse or withdraw a Trial where verification is unsuccessful or the Employer previously used the Trial through another account.

9.2 STANDARD JOB LISTING

The Standard Job Listing includes:
• One Standard vacancy
• A thirty-day listing period
• Standard website placement
• Employer profile and company logo
• Category and location placement
• Management of the Employer’s own applications
• Vacancy review before publication
The Standard Job Listing does not include Featured placement, Urgent placement, guaranteed social-media promotion or general Candidate-database access.

9.3 FEATURED JOB CAMPAIGN

The Featured Job Campaign includes:
• One Featured vacancy
• A thirty-day listing period
• Featured website placement
• Employer profile and company logo
• Management of the Employer’s own applications
• One template-based organic social-media vacancy post
• One story or status mention
• A basic campaign summary where available
• Vacancy review before publication
Featured placement does not guarantee permanent first position, exclusivity, particular reach, applications, interviews or hires.

9.4 URGENT PRIORITY CAMPAIGN

The Urgent Priority Campaign includes:
• One Urgent Priority vacancy
• A listing period of up to twenty-one days
• Urgent website placement
• Featured placement where supported and configured
• One social-media launch post
• Two story or status mentions
• One deadline reminder
• One website refresh where supported
• A basic campaign summary where available
• Priority review after complete information is received
Urgent status requires a credible closing date, immediate hiring requirement or another legitimate time-sensitive reason.
OpportunityZA may refuse Urgent status where the vacancy does not have a genuine time-sensitive requirement.

9.5 MULTI-VACANCY JOB CREDITS

OpportunityZA may sell packages containing multiple Standard Job Listing credits.
Available packages may include:
• Three Job Credits
• Five Job Credits
• Other approved credit packages introduced later
One credit allows the Employer to submit one Standard vacancy.
Each approved vacancy submitted through a credit package may remain active for thirty days after publication.
A credit is used when the vacancy is submitted.
If changes are required, the Employer must edit the existing vacancy rather than create a new submission.
Credits are not automatically restored when a vacancy is withdrawn, deleted, returned to Draft or declined.
OpportunityZA may issue a replacement credit where a verified technical or administrative error prevented the original credit from being used fairly.
Credit packages do not automatically include Featured placement, Urgent placement or social-media promotion.

10. FEATURED, URGENT AND PROMOTIONAL SERVICES

Featured, Urgent and promotional packages provide additional advertising visibility but do not guarantee:
• Permanent first position
• Exclusivity
• Website traffic
• Social-media reach
• Applications
• Interviews
• Placements
• Successful hires
Social-media services:
• Are distributed organically unless paid advertising is separately agreed
• Are scheduled according to the OpportunityZA content calendar
• Require complete and approved Employer information
• May require approved logos, brand assets and vacancy information
• Do not include paid media, professional filming, actors or guaranteed results unless expressly stated
• May include limited revisions as stated in the package description
Manual promotional work may begin after payment, verification and receipt of complete information and assets.

11. PRICES AND PAYMENTS

All prices are displayed in South African Rand unless otherwise stated.
OpportunityZA is operated by an individual sole proprietor trading under the name OpportunityZA.
OpportunityZA is not currently registered as a private company or as a VAT vendor. Prices are therefore not represented as including VAT unless OpportunityZA’s legal or tax status changes and the website is updated accordingly.
Payments may be processed through approved third-party payment providers, including Payfast.
A paid package is not considered active until:
• Payment has been confirmed
• The applicable order has been processed
• The Employer account has been registered
• Required Employer verification has been completed
A free package may still require the Employer to complete the website checkout process so that the package can be assigned to the correct Employer account.
Users are responsible for providing accurate billing and payment information.
OpportunityZA does not store complete card details. Payment information is processed through the applicable payment provider and is subject to that provider’s terms, privacy practices and security procedures.
The purchaser must review the selected package, price and order information before placing the order.

12. PACKAGE DURATION AND EXPIRY

A vacancy listing period begins when the vacancy is approved and published, unless otherwise stated.
A package may include:
• A vacancy-submission allowance
• A listing duration
• A promotional fulfilment period
• A stated credit use-by period where technically supported
• Manual social-media deliverables
Unused services or credits should be used within any validity period displayed at the time of purchase.
Employers must notify OpportunityZA if:
• A vacancy has been filled
• A closing date changes
• An application link stops working
• Vacancy information becomes inaccurate
• The Employer wants a published vacancy removed

13. APPLICATIONS AND HIRING DECISIONS

Employers are responsible for:
• Reviewing their own applicants
• Communicating accurately with Candidates
• Conducting appropriate employment and reference checks
• Following applicable employment and privacy requirements
• Making their own interview, shortlisting and hiring decisions
• Protecting Candidate information
OpportunityZA does not verify every Candidate qualification, CV statement, application message or suitability claim.
OpportunityZA does not guarantee that a Candidate is suitable for employment.
Candidates are responsible for assessing vacancies, Employers and application instructions before providing personal information.
Candidates should not pay money to apply for opportunities advertised through OpportunityZA.

14. COMMUNICATION BETWEEN USERS

Candidates may apply to vacancies through the approved application method available on the relevant vacancy.
OpportunityZA may restrict unsolicited Candidate-to-Employer messages to protect Employers from spam or unrelated enquiries.
Employers may use Candidate information only for legitimate recruitment relating to the vacancy for which the information was supplied.

15. INTELLECTUAL PROPERTY AND EMPLOYER ASSETS

Employers confirm that the Employer owns or is authorised to use all submitted:
• Logos
• Photographs
• Videos
• Vacancy descriptions
• Brand assets
• Company information
• Application links
• Promotional materials
The Employer grants OpportunityZA permission to use approved materials to provide the purchased vacancy listing or promotional service.
OpportunityZA retains ownership of its website, brand identity, original layouts, templates, written content and promotional designs, except where otherwise agreed in writing.
No user may copy, reproduce, distribute or commercially exploit OpportunityZA content without permission.

16. PLATFORM AVAILABILITY

OpportunityZA aims to keep the website operational but cannot guarantee uninterrupted or error-free access.
The platform may be affected by:
• Planned maintenance
• Hosting problems
• Payment-provider outages
• Internet interruptions
• Security incidents
• Third-party plugin or service failures
• Changes required to protect users or the platform
OpportunityZA may correct errors, update features or temporarily suspend services where reasonably necessary.

17. ACCOUNT SUSPENSION AND TERMINATION

OpportunityZA may suspend, restrict or terminate access where a user:
• Breaches these Terms and Conditions
• Provides false or unverifiable information
• Attempts to abuse the Founding Employer Trial
• Creates duplicate accounts to avoid restrictions
• Submits prohibited vacancies
• Misuses Candidate information
• Attempts unauthorised platform access
• Engages in fraudulent payment activity
• Harasses Candidates, Employers or OpportunityZA personnel
• Uses the platform for an unlawful purpose
Termination does not automatically create a right to a refund.
Refund requests will be assessed under the Refund and Cancellation Policy and applicable law.

18. PRIVACY AND PERSONAL INFORMATION

OpportunityZA processes personal information in accordance with its Privacy Policy and applicable South African data-protection requirements.
Users should not upload unnecessary identity documents, financial information or sensitive personal information through vacancy descriptions, CVs or messages.
Employers may use Candidate information only for legitimate recruitment relating to the vacancy for which the Candidate applied.
Users must take reasonable steps to protect personal information received through the platform.

19. RECORDS AND REPORTING

OpportunityZA may retain reasonable records of:
• Account registration
• Employer verification
• Package purchases
• Vacancy submissions
• Vacancy-review decisions
• Candidate applications
• Platform communications
• Promotional fulfilment
• Payment and refund activity
Where reporting is included, OpportunityZA will use only information that can be measured reliably.
Reported information may include:
• Publication and expiry dates
• Website views where available
• Application-link clicks where available
• Social-media publication links
• Organic reach and engagement where available
OpportunityZA does not guarantee any minimum result.

20. COMPLAINTS AND SUPPORT

OpportunityZA aims to acknowledge enquiries within two business days. Complex matters may require additional time.
OpportunityZA currently provides primary customer support by email. A dedicated business telephone number may be introduced and published when available.

21. REFUNDS AND CANCELLATIONS

Refund and cancellation requests are governed by the OpportunityZA Refund and Cancellation Policy available on the website.
Nothing in these Terms and Conditions is intended to exclude, restrict or replace any right that cannot lawfully be excluded.

22. THIRD-PARTY SERVICES

OpportunityZA may use third-party providers for:
• Website hosting
• Payment processing
• Email delivery
• Analytics
• Social-media distribution
• Website security
• Other platform functionality
OpportunityZA is not responsible for a third-party provider’s separate service interruption, terms, security measures or privacy practices, except to the extent required by applicable law.

23. CHANGES TO THESE TERMS

OpportunityZA may update these Terms and Conditions when services, packages, prices, operating procedures or legal requirements change.
The latest effective or updated date will appear at the top of this page.
Material changes may also be communicated through the website or by email where appropriate.

24. SEVERABILITY

If any provision of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

25. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any complaint or dispute should first be submitted to OpportunityZA for an attempt at good-faith resolution.
Nothing in this section prevents a user from exercising any right or remedy available under applicable South African law.
